Asserting your creative rights.

  • Understand your property.

Copyright law isn’t intuitive. Not all aspects of artistic works are legally protectable, and your work doesn’t have to be artistic to be protected. Neighbouring rights and moral rights complicate things. Have your lawyer advise you in plain language.

  • License it.

You make your living sharing creative projects with the world, and you license your content to business partners to get your work out there. Your work changes hands several times along the way. Make sure your interests are properly protected while negotiating a written agreement—before the matter becomes contentious.

  • Fair dealing, not stealing.

Your authorship might rely on others’ creative works. That’s often legally defensible, but only for particular purposes if done fairly. Get a freedom-to-operate opinion on your project.

  • Litigate.

When the stakes are high enough, there’s nothing left to do but ask a judge to decide on the copyright owners’ and users’ rights. Retain the right representation who will understand your interests.
